Filing Bankruptcy

There are two types of consumer bankruptcies – Chapter 7 and Chapter 13.
Chapter 7 Bankruptcy
In a Chapter 7, you are discharged from those debts which you owe with few exceptions. You may keep certain debts secured by collateral by reaffirming on those debts or agreeing to pay them.
Chapter 13 Bankruptcy
In a Chapter 13, you are paying all or a portion of those debts you have accumulated. People often file a Chapter 13 to save a house that is in foreclosure or a car that is about to be repossessed.
Once your bankruptcy is filed, a stay is in effect that prevents creditors from harassing you, sending you bills, or contacting you by phone. We advise our clients to give any creditor contacting them the case number and our name. If our clients continue to be harassed, we write a letter to manage the situation. If it is ignored, the creditor is brought before a Judge to show why he should not be held in Contempt.
